3. Account & Registration Requirements
Users must:

Be 18+ (legal requirement in India)

Provide accurate information

Maintain confidentiality of login credentials

Ensure all activities under the account comply with local laws
We may suspend accounts for violations or suspicious activity.
4. Compliance With Indian Law (Explicit)
Under the IT (Intermediary Guidelines) Rules, 2021, users must not:

Publish harmful content

Facilitate fraudulent transactions

Violate IP rights

Upload obscene, defamatory, or hateful content

5. Subscription Plans, Billing & Payments

6. User Content & Intellectual Property
User Content
You own your content.
You grant eSaapa a license to:

Transmit
solely for delivering the Services.
Platform IP
All platform technology remains exclusive property of eSaapa.com.
Users may not:

Copy source code
-
Reverse-engineer
-
Create derivative platforms
-
Misuse trademarks or brand assets
7. Prohibited Activities
Users may not use eSaapa to:

Sell illegal or prohibited products
-
Spread malware or phishing
-
Manipulate transactions
-
Spam customers
-
Scrape server data
-
Abuse APIs
-
Conduct hate speech or obscenity (India IPC laws apply)
Violation may lead to permanent termination.
8. Third-Party Services & Marketplaces
You may integrate:

Payment gateways
-
Social login tools
-
Marketplaces (Amazon, Meesho, Flipkart, etc.)
-
CRMs, SMS, and analytics tools
Each has separate Terms & Policies.
We are not liable for third-party failures.
9. SLA (Service Level Agreement)

A. Uptime

99.5% uptime guaranteed

Excludes scheduled maintenance

Excludes third-party failures

Excludes force majeure (Acts of God, cyber attacks beyond reasonable control)
B. Support SLA

Standard Plans: 24–48 business hours

Premium Plans: 4–12 business hours

Enterprise: Dedicated support
C. Scheduled Maintenance

Performed during low-traffic hours
-
Advance notifications provided
D. SLA Credits
If uptime falls below commitment:

You may request service credits
-
Credits apply to future invoices
-
No cash or refund compensation
10. Termination of Services
We may suspend or terminate accounts for:

Non-payment
-
Illegal activity
-
Repeated violations of Indian law
-
Abuse of platforms
-
Security risks
Upon termination:

Data may be retained for legal compliance

User may export data during active period
-
No refunds unless required by law
11. Limitation of Liability
To the maximum extent allowed by Indian law, GDPR, and CCPA:

eSaapa is not liable for indirect, incidental, punitive, exemplary, or consequential damages

We are not liable for financial losses, data loss, or business interruption

Maximum liability for any claim =
(Fees paid in last 12 months OR USD 100), whichever is higher
